TEXAS HEMP HARVEST FESTIVAL TERMS AND CONDITIONS

The following are the terms and conditions for attendees and vendors participating in The Texas Hemp Harvest Festival (“The Festival”). In consideration for the opportunity to attend an event, and by entering the premises, each entrant agrees to such terms and conditions, which apply regardless of the form of any ticket or other invitation to an event, or where or by whom such ticket or invitation is held, stored, or displayed.

Rules, instructions, and directions: The individual (“Attendee”) admitted to The Festival, and any minor(s) accompanying Attendee, must follow all rules of The Festival, and all posted and/or verbal directions and instructions of The Festival staff and volunteers, while present on The Festival premises. The Festival is required to follow certain COVID-19 precautions as required by Travis County and as a condition of its permit—Attendee is asked to follow these precautions.  Failure to abide by the Festival’s rules, instructions and directions may result in dismissal from the premises.

Prohibited items.  You and your belongings may be searched on entry to the event. You consent to such searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to the event without refund or other compensation. Under certain facility rules, certain items may not be brought into the premises, including without limitation: firearms and other dangerous weapons. 

Musical acts: It is possible that a musical act may have to cancel their performance or that the order of performances is changed due to unforeseen factors.  Musical acts are subject to change or cancelation at any time without notice. 

If the event is postponed, rescheduled, or moved: Occasionally, events are canceled, postponed or rescheduled to a different date or materially different time, or moved to a different venue.  If the event is postponed, rescheduled, or moved: your ticket(s) are still valid, and Attendees may request a refund of their ticket price which does not include Eventbrite fees.  If the event is canceled, postponed, rescheduled, or moved, we will attempt to contact you to update you on the status of the event, and inform you of any refund, credit, or exchange procedures. For exact instructions on any canceled, postponed, rescheduled, or moved event, please check the event information online. Refunds will only be considered if the event is canceled, postponed or rescheduled, or moved to a different venue.

We will not be liable for travel or any other expenses that you or anyone else incurs in connection with a canceled, postponed, rescheduled, or moved event.

Venue. Please note that the venue map is representative of the layout; however, it is subject to change at any time, and refunds are not allowed if the venue map is updated, if additional seats / rows are added, or if seats change because of a venue change after purchase.

Weather.  The Festival is a rain or shine event.  Please come prepared.  However, Austin sometimes experiences lighting storms in which case it may be unsafe for performers, staff, volunteers, and ticket holders to enter or remain in the venue.  If an event is cancelled before the doors open, refunds will be available.  If an event must be cancelled for safety reasons, after the doors open, refunds will not be given.

Vendors.  The Festival is a rain or shine event; however, if weather conditions or other force majeure events make holding the Festival impossible, it will be rescheduled. If the event is postponed, rescheduled, or moved, your costs to rent a space and/or to sponsor the Festival is nonrefundable but will be valid when the Festival is rescheduled, and sponsors will get the benefit of second advertising without paying additional funds.  If the event is canceled, postponed, rescheduled, or moved, we will attempt to contact you to update you on the status of the event, and inform you of any refund, credit, or exchange procedures.  Refunds for vendors may be available if the venue issues a full refund, at the event organizer’s sole discretion; however, most costs to organize the Festival are nonrefundable and therefore the event organizer is unable to refund costs for all vendors and sponsors.  For exact instructions on any canceled, postponed, rescheduled, or moved event, please contact the event organizer.

Vendors shall occupy the site space allocated under their arrangement with the Festival Organizer (“Organizer”) or other agreement.  Such space shall not be re-allocated (sublet) or be occupied by any other company than that of the Vendor without written approval of the Festival Organizer. The Vendor shall not encroach the general Festival area, alter the size, shape or position of their allocated site except in accordance with the prior written permission of the Organizer. No Vendor shall permit their Festival space to be used in such a manner as to conflict with the purpose of the Festival or the rights of other Vendors. The Vendor shall have the full right to advertise within the confines of their own stand. However, The Organizer reserves the right to prohibit any such advertising material or equipment which obstructs general flow, interferes with or obstructs neighboring sites or is in the opinion of the Organizer a source of annoyance to others. No Vendor or employee thereof may canvas or solicit other than from their allocated Festival site.  The Organizer reserves the right to alter or amend site allocation and the site plan if required. The Organizer will allocate the site space at their discretion.

The Organizer shall not be responsible or liable for any damage claimed by any person or persons who may be injured whilst in the area allocated to the Vendor. The Vendor agrees to indemnify and hold the Organizer harmless for any loss suffered in the Festival of any claim made against the Organizer.

Utilities, Tables and other Extras are all additional costs that are chargeable to the Vendor at the price agreed by the Organizer. In the case where these costs are charged post Festival, the amount payable will be deducted before any turnover reimbursement is made to the vendor.  Extra power reticulation to sites can only be supplied by the Organizer’s or Venue’s appointed electrician on application and at the Vendor’s expense.

If for any reason the Vendor does not make any of the payments as specified on the due date, the Organizer may, at its discretion, proceed to re-let the site without being liable to account to the Vendor for any sum already paid or due from them without prejudice to the Organizer.

The Vendor must not pack down their site until after closing time of the Festival. The Vendor must remove all their equipment from their allocated site during pack down. Any property remaining on site after this time will be removed by the Organizer at the Vendor’s expense.  The Organizer shall not be liable or responsible for damage to the Vendor’s equipment or accessories caused by loss, damage, theft, fire, water, storms, riots or other cause whatsoever. Any goods left at the Vendor’s site is at the Vendor’s risk.

The Vendor shall be liable for any damages caused to the venue, marquees, equipment, grass or fittings of the Festival site and infrastructure (“Festival equipment”). The owners of the Festival site or infrastructure together with the Organizer shall be the sole judges as to whether damage has occurred.

The Vendor agrees the Organizer can photograph, record, promote, advertise and market the Vendor as part of the Festival, or any partner Festivals & Events, now and in the future. No financial remuneration shall be payable to the Vendor in this case. The Vendor may provide a written request to be excluded from such promotional aspects before the date of the Festival.

Service dogs.  Please do not bring your dog or other pet to The Festival.  Service dogs are permitted.

Merchandise. All merchandise purchases are final, and in no event will there be refunds, exchanges, or credits for merchandise purchases.

Waiver and release of liability; indemnification: In exchange for admission to The Festival  premises, Attendee hereby releases, discharges, and agrees to hold harmless The Festival, the LoneStar Farms, LLC, Sweet Sensi Events, LLC, and their respective affiliates, and their respective directors, officers, volunteers, employees, agents, contractors and representatives; other Festival attendees; event performers/performer; Festival sponsors, advertisers and vendors; and the successor and assigns of each of them (each considered one of the “Releasees” herein), to the fullest extent permitted by law, from any and all liability, claims, demands, losses, and damages, which Attendee and/or any minor accompanying Attendee has or may have for any claims or causes of action arising out of or relating in any manner to attendance at The Festival premises; attendance at, observation of and/or participation in any event at The Festival premises; or any related activities. In further exchange for admission to The Festival premises, Attendee agrees to indemnify, defend and hold harmless any and all Releasees from and against any and all demands, suits, claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees and expenses), including but not limited to, any claims by or on behalf of Attendee or any accompanying minor, arising out of or relating in any manner to (i) Attendee’s and/or an accompanying minor’s attendance at The Festival premises; attendance at, observation of, and/or participation in any event at The Festival premises; or any related activities, or (ii) Attendee’s and/or an accompanying minor’s acts or omissions. In exchange for admission to The Festival premises, Attendee covenants not to sue (or assist any person in suing) any Releasee for any matter related to the above assumptions, releases, indemnifications, or agreements.

You agree to comply with all The Festival’s applicable rules, policies, terms, and conditions. The Festival reserves the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language or who fails to comply with The Festival rules. Breach of terms or rules will terminate your license to attend the event without refund. A ticket is a revocable license and admission may be refused upon refunding the ticket’s face amount. A ticket is not redeemable for cash.

Governing Law.  These Terms are governed by the laws of the State of Texas, without regard to its principles of conflicts of laws. Attendee and the Organizer hereby irrevocably submit to the exclusive jurisdiction of the United States federal and state courts located in Austin, Texas, including waiving any objection to personal jurisdiction, and agree that any such court will be the proper forum for the determination of any dispute arising hereunder.  Within 60 days of the arising of any claim, You agree to notify the Organizer and to participate in a good faith mediation before a neutral third party in an effort to amicably resolve the dispute.  If such mediation is unsuccessful, then the  Organizer retains all remedies available to it at law and is entitled to its attorneys’ fees and costs if it prevails.

Force Majeure event:  Events including but not limited to any act of God, natural disaster, fire, flood, council or government sanction or order, actions or decisions of police or courts or agencies or other authorities, act of terrorism, war or industrial action, pandemic, epidemic, or cancellation by the Venue owner, lessee or controller. The parties agree that where it is impossible or unreasonably impractical for the Festival to take place due to any cause or event in connection with COVID-19 or any other communicable disease, it shall be treated as a Force Majeure Event, regardless of whether the parties could have reasonably foreseen the risk of such Force Majeure Event at the time of contract.

These terms and conditions may be updated without notice.
